Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the kryyt website, application at app.kryyt.com, and API at api.kryyt.com (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract.

2. The Service

kryyt provides a unified, OpenAI-compatible API and chat platform that routes your requests to third-party AI models. Available models and their status may change over time; some models are marked "coming soon" and are not yet available. We may add, modify, deprecate, or remove models and features.

3. Accounts & API keys

You are responsible for the accuracy of your account information, for safeguarding your credentials and API keys, and for all activity under your account. Notify us promptly of any unauthorized use. You must not share keys publicly or embed them in client-side code.

4. Free allowance

Free usage, refreshed monthly. Input, output, and cached-input usage, plus web searches and page fetches, all draw from the same free allowance at their applicable rates. Available usage depends on the models and features you use. The allowance refreshes each calendar month; unused allowance expires and does not accumulate. API projects use purchased credits only. Free allowance has no cash value and cannot be transferred, shared, or refunded. We may change or discontinue the allowance with notice.

4b. Referral program

A registration referral program is planned but is not available in the current release. Eligibility and terms will be published before it launches.

5. Fees, billing & Merchant of Record

Usage is charged at Kryyt's published rates for the selected model and features. Review current pricing and usage in your account.

Subscriptions. Plans (currently Starter, Plus, and Power) include a set amount of kryyt usage per billing period, which begins on your subscription anniversary. Included usage is released in daily allocations through the period; a portion of unused allocation may carry forward within the period, and any remaining included usage expires at the end of the period. Subscription usage applies to chat and the VS Code extension, not the API, and cannot be transferred or shared. Plan changes may be prorated. Cancellation takes effect at the end of the current billing period.

Pay-as-you-go credits. Credits are purchased with a minimum top-up of $10 and do not expire. API usage is billed only against pay-as-you-go credit. You may share purchased credits with other individuals or groups and set daily, weekly, monthly, or lifetime limits per recipient; shared credits remain in your balance and you are responsible for usage under them. When included subscription usage is exhausted, we will ask for your permission before drawing on prepaid credit.

Merchant of Record. Paddle acts as our Merchant of Record. Your purchase contract for payment is with Paddle, receipts are issued by Paddle, and Paddle handles payment processing, sales tax/VAT, invoicing, and refunds under the Paddle Buyer Terms. We may change plans and pricing prospectively with notice.

6. Refunds

Refund requests are handled under our Refund Policy, which provides a 14-day request window reviewed in line with Paddle's Buyer Terms, and any non-waivable consumer rights that apply to you.

7. Acceptable use

You agree not to use the Service to:

  • break the law or infringe others' intellectual-property, privacy, or other rights;
  • generate or distribute malware, spam, or content that is unlawful, harmful, harassing, or that sexualizes minors;
  • attempt to reverse engineer, resell, or circumvent rate limits or access controls, or to disguise the origin of traffic;
  • violate the acceptable-use or other terms of the underlying model providers;
  • submit personal data of others without a lawful basis.

We may suspend or terminate access for violations.

8. Your content & license to operate the Service

As between you and kryyt, you retain your rights in the inputs you submit and the outputs generated for you, to the extent permitted by law and the model providers' terms. You grant kryyt a worldwide, non-exclusive license to host, store, transmit, process, and display your inputs, outputs, and files as needed to operate and secure the Service and to provide account and chat continuity, including the ongoing retention described in our Privacy Policy. You are responsible for ensuring you have the rights to submit your content.

9. Third-party model providers

Responses are produced by third-party models. Your use of a given model is also subject to that provider's terms and license. Model availability, capabilities, context limits, and pricing are set in part by providers and may change. We are not responsible for provider outages or changes.

10. AI output disclaimer

AI output may be inaccurate, incomplete, biased, or otherwise unsuitable, and may not be unique to you. You are solely responsible for evaluating and verifying outputs before relying on them, and for any decisions or content you derive from them. Do not use the Service for advice requiring a licensed professional without independent verification.

11. Intellectual property

The Service, including the kryyt name, logo, software, and website, is owned by kryyt or its licensors and protected by law. These Terms grant you no rights in our marks or software except the limited right to use the Service.

12. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the maximum extent permitted by law, kryyt will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the greater of the amounts you paid to us (via Paddle) in the three months before the claim, or USD 100. Nothing limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold kryyt harmless from claims, losses, and expenses arising from your content, your use of the Service, or your breach of these Terms or applicable law.

15. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for breach, legal risk, or abuse. On termination, your right to use the Service ends; provisions that by their nature should survive (including IP, disclaimers, liability, and indemnity) survive.

16. Governing law & changes

kryyt is headquartered in Chicago, Illinois, United States. These Terms are governed by the laws of the State of Illinois and applicable U.S. federal law, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your country. We may update these Terms; material changes will be posted here and continued use constitutes acceptance.
